Probate Services - Simplified Dissolution

Simplified Dissolution information may be obtained from the Civil Division in the Office of the Clerk of Court located at the Court House, 430 South Commerce Ave., Room 105, Sebring, Florida. The office hours are from 8:00am to 5:00pm Monday thru Friday. The telephone number is (863) 402-6594.

You may use the Simplified Dissolution of Marriage form only if all the following statements are true. If any one of the statements is not true, you cannot use this form.

  • We have no minor (under 18) children or dependent children.
  • We have no adopted children under 18 years of age.
  • The wife is not pregnant.
  • At least one of us has lived in Florida for the past 6 months.
  • We have made provisions for the division of our property and the payment of our obligations and we are satisfied with them.
  • We have both signed the joint petition and all other papers needed to carry out this procedure and paid the required fees to the Clerk of the Circuit Court.
  • We both want to end the marriage because of serious permanent differences.
  • We both have agreed to use the simplified dissolution of marriage procedure rather than a regular dissolution.
  • We are both aware of the following facts:
    1. That after the dissolution of marriage becomes final, neither of us has any right to expect money or support from the other, except for what is included in the Property Settlement; and
    2. That by choosing the simplified dissolution of marriage procedure we give up certain legal rights that we would have if we had used the regular dissolution procedure.
  • We are able to and will both appear at the final court hearing together.
